Welcome to Nyaya.ai ("we," "our," or "the Platform"). By accessing, registering for, or utilizing the Nyaya.ai platform, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions set forth below, you may not access the Platform or use any of our services. These terms govern your use of our artificial intelligence inference engines, legal document processing tools, and subscription services.

2. Nature of Service & Disclaimer of Legal Advice

Nyaya.ai is an artificial intelligence research instrument, not a law firm, attorney, or substitute for professional legal counsel.

The outputs, summaries, citations, and draft documents generated by Nyaya.ai are derived from probabilistic artificial intelligence models analyzing public legal datasets (including the BNS, BNSS, IPC, CrPC, and various judicial precedents). While we strive for absolute accuracy, AI outputs can hallucinate, omit context, or misinterpret nuances. You expressly acknowledge that:

• No attorney-client privilege is established by your use of the Platform.
• You must independently verify all citations, section numbers, and case laws generated by the AI before utilizing them in a court of law, legal filing, or client advisory.
• Nyaya.ai shall not be held liable for any legal penalties, dismissed cases, or damages resulting from reliance on the Platform's outputs.

3. Data Collection, Privacy, and Confidentiality

Protecting the confidentiality of your research is foundational to Nyaya.ai. Below is an exhaustive summary of the data we collect, why we collect it, and how it is protected.

A. Data We Collect

• Account Information: We collect your email address and authentication metrics strictly to provide access to your account and manage your subscription state.
• Conversational Queries: We temporarily process the text prompts and legal questions you input into the chat interface to generate accurate responses from our language models.
• Uploaded Documents: If you utilize our OCR / Document Processing feature, the files (PDFs, Images, Text) you upload are processed exclusively to extract text, enabling the AI to read and contextualize your specific case files.
• Usage Analytics: We track quantitative metrics (e.g., number of messages sent, tokens generated, endpoints accessed) to enforce rate limits and ensure fair usage across our infrastructure.

B. How We Use Your Data

The data collected is utilized solely to operate, maintain, and secure the Platform. We do not sell your personal data to third-party data brokers. We do not use your private legal queries or uploaded evidentiary documents to train, fine-tune, or improve our base AI models. Once an uploaded document is processed and the relevant text is extracted for your immediate session context, the underlying file is securely discarded from active memory.

Your data is secured using industry-standard encryption protocols. However, you acknowledge that no digital transmission over the internet is entirely immune to interception, and you should refrain from uploading highly classified or unredacted sensitive personal information of your clients where legally prohibited.

4. User Responsibilities & Acceptable Use

As a user of Nyaya.ai, you agree not to:

• Utilize the Platform to generate fraudulent documents, perjurious affidavits, or illegal content.
• Attempt to reverse-engineer, decompile, or extract the underlying architecture, weights, or system prompts of our AI engines.
• Use automated scripts, bots, or scraping tools to bypass our rate limits or extract database contents.
• Share, sell, or distribute your Premium account credentials to multiple users.

Violation of these terms may result in immediate, uncompensated termination of your account.

5. Intellectual Property

The Nyaya.ai name, branding, user interface designs, and proprietary code are the exclusive intellectual property of Nyaya.ai. You retain full ownership of the inputs (prompts) you provide and the immediate outputs (generated text and PDFs) the AI produces during your session.

6. Subscription, Payments & Refund Policy

Nyaya.ai operates on a freemium model. Free tier users are granted a limited number of daily standard-engine queries. Premium users are billed dynamically based on the plan selected (e.g., Monthly or Annual) to access advanced capabilities like Turbo-IQ processing and document extraction.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NYAYA.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; OR (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Nyaya.ai and its individual owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Platform, your violation of these Terms, or your infringement of any third-party rights.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts located in New Delhi, India.

10. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Platform (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any such modification or discontinuation. We also reserve the right to update these terms at our discretion; your continued use of the Platform constitutes acceptance of the updated terms.
