Statutory Content of Section 64

Section 64 of the Sale of Goods Act, 1930, provides that where goods are sold by auction, the sale is complete when the auctioneer announces its completion by the fall of the hammer, or in other customary manner. The section reads: "Where goods are sold by auction, the sale is complete when the auctioneer announces its completion by the fall of the hammer, or in other customary manner." The section also provides that until the sale is complete, the auctioneer may withdraw the goods from sale or reopen the bidding. The Delhi High Court in the case of M/s. B. L. Gupta & Co. v. M/s. K. K. Bhatia, AIR 1974 Del 141, held that the sale of goods by auction was complete when the auctioneer announced its completion by the fall of the hammer, and the buyer was bound to pay the purchase price.
