Section 65 of the Sale of Goods Act, 1930, provides that a contract of sale may be made by sample, where the goods are to be delivered in accordance with the sample. The section reads: "A contract of sale may be made by sample, where the goods are to be delivered in accordance with the sample." The section also provides that the bulk of the goods delivered must correspond with the sample in quality, and the buyer is entitled to reject the goods if they do not correspond with the sample. The Calcutta High Court in the case of M/s. J. K. Hosiery Factory v. M/s. S. K. Hosiery Factory, AIR 1965 Cal 392, held that the buyer was entitled to reject the goods delivered, as they did not correspond with the sample in quality.
