Where a person takes a negotiable instrument from another person, by virtue of any threat or force, or by any means which render the act of taking not a voluntary act of that person, such instrument shall be deemed to have been obtained by fraud, and the person taking the same shall be deemed to be a holder in due course only to the extent to which he is able to prove that the instrument was taken without his knowledge or consent.
