Where a person takes a negotiable instrument from another person, and at the time of taking the same, such person has an interest in the same, such instrument shall be deemed to have been obtained by fraud, and the person taking the same shall be deemed to be a holder in due course only to the extent to which he is able to prove that the instrument was taken without his knowledge or consent.
