धारा 68

Section 68 of the Negotiable Instruments Act, 1881, states that 'where the drawer of a cheque having a crossing specially to a banker has been paid by the banker on whom it is drawn, and the banker on whom it is drawn has in good faith and without negligence collected the amount from the banker to whom it is crossed, the drawer shall be liable to compensate the banker for the loss, if any, which he has incurred owing to the cheque having been so paid'. This means that if a paying banker pays a cheque crossed specially to the drawer, and the banker on whom it is drawn has collected the amount from the banker to whom it is crossed, the drawer is liable to compensate the banker for any loss incurred. The Supreme Court of India has held that the liability of the drawer is limited to the amount of the loss incurred by the banker.
