Statutory Content of Section 67

Section 67 of the Negotiable Instruments Act, 1881, provides that 'where a cheque is crossed specially to a banker, the banker on whom it is drawn shall not pay it except to that banker or to his agent for collection'. This means that a cheque that has been crossed specially can only be paid to the banker specified in the crossing, or to his agent for collection. The effect of a special crossing is that the cheque can only be paid to the banker specified, and the banker is required to collect the proceeds of the cheque for the account of the payee or the holder of the cheque. The Supreme Court of India has held that a paying banker who pays a cheque crossed specially to a banker other than the one specified is liable for the amount of the cheque.
