Statutory Content of Section 66

Section 66 of the Negotiable Instruments Act, 1881, states that 'where a cheque is crossed generally, the banker on whom it is drawn shall not pay it otherwise than to a banker'. This means that a cheque that has been crossed generally can only be paid to a banker, and the paying banker is required to verify that the cheque is being presented by a banker before making payment. The effect of a general crossing is that the cheque can only be paid through a bank, and the bank is required to collect the proceeds of the cheque for the account of the payee or the holder of the cheque. The Supreme Court of India has held that a paying banker who pays a cheque crossed generally to a non-banker is liable for the amount of the cheque.
