Section 69 of the Negotiable Instruments Act, 1881, provides that 'where a cheque is crossed, the banker on whom it is drawn shall, at the request of the drawer or the holder, without expense to the drawer or holder, and without delay, ascertain and intimate, by telegraph or otherwise, to the drawer or holder, whether the banker to whom the cheque is crossed has made any claim thereto, and has given notice of dishonour, if any'. This means that the banker on whom a cheque is drawn is required to inform the drawer or holder of the cheque, at their request, whether the banker to whom the cheque is crossed has made any claim to the cheque or has given notice of dishonour. The Supreme Court of India has held that the banker is required to provide this information without delay and without expense to the drawer or holder.
