Statutory Content of Section 64

Section 64 of the Negotiable Instruments Act, 1881, states that 'a cheque may be crossed generally or specially after it has been drawn, and a cheque so crossed may be further crossed specially'. This means that a cheque can be crossed at any time after it has been drawn, and the crossing can be either general or special. The crossing of a cheque after it has been drawn does not affect its validity, and the cheque remains a valid negotiable instrument. However, the crossing of a cheque after it has been drawn may affect the liability of the parties to the cheque, and the paying banker may be required to verify the crossing before making payment.
