Statutory Content of Section 63

Section 63 of the Negotiable Instruments Act, 1881, provides that 'where a cheque bears across its face an addition of the name of a banker, either with or without the words 'not negotiable', that addition shall be deemed a special crossing, and the cheque shall be deemed to be crossed specially to the banker named therein'. A special crossing is a direction to the paying banker to pay the amount of the cheque only to the banker specified in the crossing. The effect of a special crossing is that the cheque can only be paid to the banker specified, and the banker is required to collect the proceeds of the cheque for the account of the payee or the holder of the cheque. The Supreme Court of India has held that a special crossing is a more specific direction than a general crossing, and the paying banker is bound to comply with the direction.
