Statutory Content of Section 118

Section 118 of the Indian Contract Act, 1872, deals with the right of each promisor to compel contribution. It states: 'When two or more persons have made a joint promise, and one of them has performed the whole or part of the promise, he may compel every other joint promisor to contribute equally with him to the whole of the promise, unless a contrary intention appears by the contract.' This section provides that when one joint promisor has performed the promise, either in whole or in part, they can demand contribution from the other joint promisors. The courts have held that the right to contribution arises only after one of the promisors has performed the promise.
