What does Section 18 of TPA say?

Where a contract is made with a person competent to transfer ownership in immovable property for the transfer of such property, and the property is in existence at the time of the contract, then, if the contract is not intended to be a contract of mortgage, the property shall be transferred as agreed, and if the contract is intended to be a contract of mortgage, the property shall be mortgaged as agreed.
