What does Section 17 of TPA say?

Where a contract is made with a person competent to transfer ownership in immovable property for the transfer of such property, and the property is not in existence at the time of the contract, then, if the property comes into existence in accordance with the contract, the contract shall be binding upon the parties thereto, and the property shall be transferred as agreed, and if the property does not come into existence in accordance with the contract, the contract shall be void.
