Where a contract is made with a person competent to transfer ownership in immovable property for the transfer of such property, and the property is not in existence at the time of the contract, and the contract is intended to be a contract of mortgage, then, if the property comes into existence in accordance with the contract, the mortgage shall be binding upon the parties thereto, and if the property does not come into existence in accordance with the contract, the mortgage shall be void.
