Section 49 of the Sale of Goods Act, 1930, states that '(1) where the seller of goods agrees to deliver them at a place other than where they are, and the goods are delivered to a carrier for the purpose of transmission to such place, the seller shall be deemed to have delivered the goods to the buyer, unless the seller has otherwise agreed. (2) where the goods are delivered to a carrier for the purpose of transmission to a place other than where they are, and the seller has not agreed to deliver them at such place, the risk of loss or damage to the goods shall be borne by the buyer from the time of such delivery.'
