Statutory Content of Section 47

Section 47 of the Sale of Goods Act, 1930, provides that '(1) where the seller has exercised his right of lien or stoppage in transit, he may re-sell the goods, and, if the buyer has paid any part of the price, the re-sale shall be subject to a credit of such part of the price. (2) where the seller has re-sold the goods, the buyer shall be entitled to the delivery of the proceeds of the re-sale, subject to a credit of such part of the price as the buyer has paid.' This section outlines the seller's right to re-sell goods after exercising his right of lien or stoppage in transit and the buyer's entitlement to the proceeds of the re-sale, subject to a credit for any part of the price already paid.
