Section 37 of the Sale of Goods Act, 1930, states: 'Where, in pursuance of a contract of sale, the seller is bound to deliver the goods to the buyer by sending them to him, but has not named a specific carrier, the seller may, in the absence of any express or implied agreement to the contrary, deliver the goods to any carrier whose route includes the buyer's destination, on such terms as to the mode of transit, and as to the time of starting and arrival, as may be reasonable having regard to the nature of the goods and the other circumstances of the case.' This section deals with the delivery of goods to a carrier, where the seller is bound to send the goods to the buyer but has not specified a particular carrier. The section provides that the seller can deliver the goods to any carrier whose route includes the buyer's destination, on reasonable terms.
