Section 20 of the Sale of Goods Act, 1930, provides that if an agent discloses the name of his principal, the agent is not personally liable on the contract. The section further provides that if the agent has already incurred personal liability on the contract, the disclosure of the principal's name does not affect the agent's liability. The Supreme Court of India has held that if an agent discloses the name of his principal, the agent is not personally liable on the contract, unless the agent has already incurred personal liability on the contract (State of Madras v. M. & M. Asbestos Products, (1964) 2 SCR 703).
