Section 19 of the Sale of Goods Act, 1930, provides that if a person enters into a contract of sale as an agent, but does not disclose the name of his principal, the agent is personally liable on the contract. The section further provides that if the agent discloses the name of his principal, he is not personally liable on the contract. The Bombay High Court has held that if an agent enters into a contract of sale without disclosing the name of his principal, the agent is personally liable on the contract (Keshavji Chhaganlal v. The Bombay Dyeing and Manufacturing Co. Ltd., AIR 1959 Bom 293).
