Statutory Content of Section 61

Section 61 of the Negotiable Instruments Act, 1881, states that 'a cheque may be drawn in ordinary language and need not contain the word 'cheque' if it complies with the requirements of section 6'. This means that as long as the instrument contains an unconditional order to pay a certain sum of money, it can be considered a cheque, regardless of the language used. The key requirement is that it must be an order to pay, and not a request or an authorization. The Supreme Court of India has held that the use of the word 'cheque' is not mandatory, and what is essential is that the instrument should contain the essential features of a cheque as defined under the Act.
