Statutory Content of Section 60

Section 60 of the Negotiable Instruments Act, 1881, deals with the content of the notice of dishonor. The section states that 'the notice referred to in section 59 may be given in writing or by personal communication, and must state the following particulars, namely: (a) the amount for which the instrument was drawn; (b) the date of the instrument; (c) the cause of dishonor; and (d) that the instrument is dishonored.' The section further explains that the notice must be given in a manner that is reasonable and sufficient to inform the parties of the dishonor. The section also provides that the notice can be given by the holder or by his agent. The Bombay High Court has held that the notice of dishonor must contain the particulars specified in the section (Bank of Baroda v. M. M. Kabra, AIR 1969 Bom 141).
