Statutory Content of Section 5

As per Section 5 of the Negotiable Instruments Act, 1881, 'Every person capable of contracting, according to the law to which he is subject, may bind himself and his representatives by a promissory note.' The section further explains that 'A minor may draw, indorse, deliver and negotiate promissory notes and bills of exchange, and all such instruments so drawn, indorsed, delivered and negotiated shall be valid, except as against him, in respect of any liability to which he may be subject under the same.'
