Statutory Content of Section 33

Section 33 of the Negotiable Instruments Act, 1881, addresses the issue of negotiable instruments made or delivered without consideration. The section reads: 'A negotiable instrument made, drawn, accepted, indorsed or transferred without consideration, or for a consideration which fails, shall be invalid to the extent of the consideration which is illegal or insufficient.' This provision underscores the principle that a negotiable instrument must be supported by a valid consideration to be enforceable. If the consideration is illegal or fails, the instrument's validity is compromised to the extent of the invalid consideration. The section is crucial in preventing the use of negotiable instruments for unlawful purposes or in situations where the consideration does not meet legal standards. Courts have interpreted this section to mean that the absence or failure of consideration can render the instrument unenforceable, but the burden of proving the lack of consideration lies on the party asserting it.
