Section 10 of the Negotiable Instruments Act, 1881, defines a cheque as 'a bill of exchange drawn on a specified banker and not expressed to be payable otherwise than on demand.' The section further explains that 'A cheque may be drawn on any banker, whether he has or has not a branch in the place where the cheque is drawn, and whether he has or has not an account with the drawer.' The drawer of the cheque is the person who signs the instrument and orders the banker to pay the amount.
