Nothing is an offence which is done by accident or misfortune, and without any criminal intention or knowledge, and in the doing of a lawful act in a lawful manner, by means and with proper precautions to guard against any probable harm to person or property, and where the person doing the act had no reason to believe that it would cause harm to any person or property.
