Statutory Content of Section 104

The right of private defence of property extends to causing any harm other than death to the wrong-doer, if the offence, the committing of which, or the attempting to commit which, occasions the exercise of the right, is an offence of any of the following descriptions:— First.—Robbery; Second.—House-breaking by night; Third.—Mischief by fire committed on any building, tent or vessel, which building, tent or vessel is used as a human dwelling or as a place for the custody of property; Fourth.—Theft, if the offender, in order to effect the theft, has used any fraudulent means of entry into a building, tent or vessel, which building, tent or vessel is used as a human dwelling or as a place for the custody of property; Fifth.—Any offence under section 452 or section 453 or section 454 or section 455.
