Section 8

No decree for specific performance of a contract for the sale of immovable property shall be made in any of the following cases, namely: (a) where the contract has been cancelled by the party against whom the decree is sought; (b) where the party in whose favour the decree is sought is not ready and willing to perform the contract; (c) where the other party to the contract has been guilty of any material breach thereof; (d) where the contract has not been properly stamped; (e) where the party against whom the decree is sought has not been given a reasonable opportunity of raising the objection of want of stamp.
