What does Section 44 of Specific Relief Act, 1963 say?

Where any contract is for the sale of movable property, the court shall not grant a decree for specific performance of that contract, unless the buyer has paid a sum of money as a part payment of the price, or has given a bank draft or a cheque for the whole of the price, or the seller has delivered the property to the buyer.
