Where any party to a contract (whether enforceable by specific relief or not) has refused to perform or has neglected to perform or has broken any promise or any term of such contract, the party who so refuses or neglects or breaks any promise or term may, on notice to the other party, institute a suit to enforce specific performance by such party of the contract, and any damages which the plaintiff may have sustained by reason of such refusal, neglect or breach.
