Section 34

Section 34 of the Sale of Goods Act, 1930, states: 'A delivery of part of the goods, in pursuance of a contract of sale, is a delivery of the whole, if it is made with the intention of delivering the whole, and the buyer has a right to reject the whole, if the part delivered is not in accordance with the contract.' This section deals with the effect of part delivery, where the seller delivers only a portion of the goods. The section provides that if the part delivery is made with the intention of delivering the whole, the buyer has the right to reject the whole if the part delivered does not conform to the contract. In the case of Varley v. Whipp, the court held that the buyer's acceptance of part delivery does not necessarily imply acceptance of the whole, and the buyer can still reject the whole if the part delivered is not in accordance with the contract.
