Section 33

Section 33 of the Sale of Goods Act, 1930, states: 'The delivery of goods sold may be by doing anything which the parties agree shall be treated as such delivery, or by doing anything which has the effect of putting the goods in the possession of the buyer, or of any person authorized by the buyer to take delivery of them.' This section provides that delivery can be effected by any means agreed upon by the parties or by any act that has the effect of putting the goods in the possession of the buyer or their authorized representative. The section emphasizes the importance of the parties' agreement in determining what constitutes delivery. In the case of Benyon v. Nettlefold, the court held that the delivery of goods can be made by the seller leaving the goods at the buyer's premises, even if the buyer is not present, as long as the buyer has authorized someone to take delivery on their behalf.
