Section 123

According to Section 33 of the Indian Contract Act, 1872, when the event on which a contingent contract is made happens, the contract becomes enforceable. However, if the language of the contract is such that it appears the parties intended that the contract should be enforceable only if the event happens before a certain time or within a specified period, and the event happens after that time or period, the contract becomes void. The courts have interpreted this to mean that the intention of the parties at the time of contracting is crucial in determining whether the contract is enforceable. If the parties intended for the contract to be enforceable only upon the occurrence of the event within a certain timeframe, and the event occurs outside this timeframe, the contract will not be enforceable.
