Section 122

Section 32 of the Indian Contract Act, 1872, deals with the enforcement of contingent contracts. It states that contingent contracts are not enforceable unless the event on which they are contingent occurs. If the event becomes impossible, the contract becomes void. For example, if a contract is made to marry a certain person, and before the time appointed for the marriage, the person dies, or is married to another, the contract becomes void. The courts have held that the event must be of such a nature that its occurrence or non-occurrence can be ascertained with certainty. If the event is vague or impossible to ascertain, the contract may not be enforceable. Furthermore, if the event on which the contract is contingent is the doing of an act which is impossible or unlawful, the contract is void.
