Where a contract is made with a person as a consideration for the transfer of property to him, and the property is not in existence at the time of the contract, the property which is to be transferred shall be deemed to be the property which the party contracting to transfer has power to create or acquire at the time when the property comes into existence, unless a different intention appears from the context.
