A contract by a person competent to transfer property, or by his agent, to vest unconditionally the absolute ownership of such property in a third person, or to vest such ownership conditionally on the happening of an event, or to create a trust, shall be void, unless the contract is in writing and executed in the presence of at least two witnesses.
