Statutory Content of Section 31

A decree for specific performance may be made in all cases in which the court is satisfied that the defendant has not performed or has not fulfilled a material term of the contract, and that, in the event of such non-performance or non-furnishing, the plaintiff would suffer irreparable loss. The court may, on the application of the plaintiff, make a decree for specific performance of a contract, notwithstanding that, at the time of the application, the contract has not been breached by the defendant, if the court is satisfied that the defendant is, without any reasonable cause, refusing or neglecting to perform the contract. The court may, in its discretion, refuse to grant a decree for specific performance of a contract, if it is satisfied that the contract has been obtained by fraud or coercion, or that the defendant has been guilty of gross misconduct in the performance of the contract.
