Where any party to a contract (whether enforceable by law or not) has refused to perform or has neglected to perform or has broken any promise or has been guilty of any conduct in derogation of the terms of such contract, the party who so refuses or neglects or breaks a promise or who is so guilty of conduct may, upon breach of contract, institute a suit for specific performance of such contract, and the court may, on such terms as it thinks fit, order that the contract be performed, and may make all such further or other order as the court thinks just.
