Section 57 implies a condition that goods shall be of merchantable quality. The section states: “If the buyer has examined the goods, there is no implied condition as regards defects which that examination ought to have revealed.” However, if the buyer has not examined the goods, there is an implied condition that the goods are of merchantable quality. Judicial pronouncements have clarified that merchantable quality refers to the standard that a reasonable buyer would expect from goods of that description.
