Statutory Content of Section 54

Section 54 deals with contracts for the sale of goods by sample. The section states: “A contract of sale may be made by the seller delivering the goods to the buyer and the buyer accepting them, or by the buyer accepting the goods from the seller without their actual delivery, or by the seller and the buyer agreeing that the buyer shall have the goods.” In such contracts, the bulk of the goods must correspond with the sample in quality. Judicial pronouncements have emphasized the importance of the sample being a true representation of the goods.
