Statutory Content of Section 44

Section 44 of the Sale of Goods Act, 1930, states that '(1) subject to the provisions of this section, when the buyer of goods becomes insolvent and the seller has not received the whole of the price, the seller, if in possession of the goods, may, by giving notice to the buyer or the buyer's representative that the seller has resumed possession of the goods, stop the goods in transit, unless the buyer or the buyer's representative gives a written guarantee to pay the price. (2) For the purposes of sub-section (1), the goods shall be deemed to be in transit from the time when they are delivered to a carrier or other bailee for the purpose of transmission to the buyer, until the buyer or the buyer's representative takes delivery of them.' This section allows the seller to stop goods in transit if the buyer becomes insolvent and the full price has not been paid, by giving appropriate notice and under the condition that the buyer does not provide a written guarantee for the payment.
