Section 39 of the Sale of Goods Act, 1930, states: 'Where the contract of sale requires the goods to be delivered at a place other than where they are, and the seller is bound to send the goods to the buyer by sea or inland navigation, the risk of deterioration, loss or damage to the goods shall be borne by the buyer, unless the seller has been guilty of some neglect or default, or unless the goods are of a perishable nature, in which case the risk shall be borne by the seller.' This section deals with the risk of deterioration, loss, or damage to goods where the contract requires delivery at a distant place. The section provides that the risk is generally borne by the buyer, unless the seller has been guilty of neglect or default, or the goods are of a perishable nature.
