Statutory Content of Section 23

Section 23 of the Sale of Goods Act, 1930, states: 'In the case of a contract for the sale of goods by sample, there is an implied condition: (1) that the bulk shall correspond with the sample in quality; (2) that the buyer shall have a reasonable opportunity of comparing the bulk with the sample; (3) that the goods shall be free from any defect, rendering them unmerchantable, which would not be apparent on reasonable examination of the sample'. This section deals specifically with sales by sample, imposing conditions that the bulk of the goods must match the sample in quality, the buyer must have a reasonable chance to compare the bulk with the sample, and the goods must not have defects that would make them unmerchantable, beyond what a reasonable examination of the sample would reveal. These conditions are fundamental to ensuring that buyers receive goods that are consistent with what they have been shown.
