Section 15 of the Sale of Goods Act, 1930, provides that if a contract of sale is by description, there is an implied undertaking by the seller that the goods will correspond with the description. The section further provides that if the goods do not correspond with the description, the buyer may reject the goods. The Bombay High Court has held that if a contract of sale is by description, the seller is bound to supply goods that correspond with the description, and if he fails to do so, the buyer is entitled to terminate the contract (Hiralal v. The Bombay Dyeing and Manufacturing Co. Ltd., AIR 1958 Bom 293).
