This section deals with the dishonor of a negotiable instrument by non-acceptance. According to Section 57 of the Negotiable Instruments Act, 1881, 'a promissory note, bill of exchange or cheque is said to be dishonored by non-acceptance when the drawee or the acceptor refuses to accept it, or does not accept it within the time allowed for acceptance.' The section further explains that the dishonor by non-acceptance will make the parties to the instrument liable to pay the amount. The section also provides that the holder can recover the amount of the instrument from the parties liable. The Calcutta High Court has held that the dishonor of a cheque by non-acceptance makes the drawer liable to pay the amount (United Bank of India v. S. K. Dey, AIR 1962 Cal 414).
