This section deals with the presentment of a cheque to charge the drawer. According to Section 53 of the Negotiable Instruments Act, 1881, 'a cheque must, in order to charge the drawer, be presented at the bank on which it is drawn before the close of business on the day next following its date.' The section further explains that if the cheque is not presented within the specified time, the drawer will not be liable to pay the amount. However, the section also provides that the drawer will still be liable if the cheque is presented within a reasonable time after the drawer has received notice of the dishonor of the cheque. The Calcutta High Court has held that the presentation of a cheque within three days of its date is a reasonable time (United Bank of India v. Hem Chandra, AIR 1962 Cal 414).
