Statutory Content of Section 39

Section 39 of the Negotiable Instruments Act, 1881, outlines the powers of the holder of a crossed cheque. The section provides that the holder of a crossed cheque has the right to cross it specially to any bank, and where a cheque is crossed generally, the holder may cross it specially to any bank. This provision allows the holder to direct the payment of the cheque to a specific bank, enhancing the security of the transaction by limiting the banks through which the cheque can be paid. Judicial interpretations have focused on the flexibility this section offers to the holder in managing the payment process, ensuring that the crossing of a cheque does not unduly restrict its negotiability while maintaining the added security of requiring payment through a bank.
