Section 2 of the Negotiable Instruments Act, 1881, provides the definitions of various terms used in the Act. It states that 'In this Act- "Banker" means a person transacting the business of accepting, for the purpose of lending or investment, of deposits of money from the public, repayable on demand or otherwise and withdrawable by cheque, draft, order or otherwise; "Cheque" means a bill of exchange drawn on a specified banker and not expressed to be payable otherwise than on demand; "India" means the territory of India excluding the State of Jammu and Kashmir; "Issue" means the first delivery of a promissory note, bill of exchange or cheque, complete in all particulars, to a person who takes it as a holder, and "issue" of a promissory note or bill of exchange is also the first delivery of it for the purpose of circulation, whether to the payee, the drawee, or some other person; "Promissory note" means an instrument in writing (not being a bank-note or a currency-note) containing an unconditional undertaking, signed by the person to whom the money is payable, to pay on demand or at a fixed or determinable future time a certain sum of money only to, or to the order of, a certain person, or to the bearer of the instrument.' These definitions are crucial for understanding the provisions of the Act.
