Every instrument must be delivered in order to be valid. As per Section 19 of the Negotiable Instruments Act, 1881, 'The making, acceptance, or endorsement of a promissory note, bill of exchange or cheque is not complete until delivery of the instrument.' The delivery of an instrument is essential for its validity and the instrument is not complete until it is delivered. The Bombay High Court in the case of Bank of Baroda vs. M. S. Shah (1985) has held that the delivery of an instrument is essential for its validity and that the instrument is not complete until it is delivered.
