Where any bill of exchange, hundi, cheque, promissory note, is made without consideration, or where any such instrument is made for a consideration which has failed, the maker of the instrument shall be discharged, unless and until he has affirmed the contract in writing, or has received payment for the instrument, or has issued a new instrument in lieu thereof, or has in any other way affirmed the contract.
